Personal Injury – If you or a family one has been injured in an accident as a result of another person’s negligence, consult an attorney before making any decision or making any resolution with an insurance company.  Remember that an insurance adjuster represents his company, not you.  It is not his duty to maximize your settlement.  An attorney representing you has a duty to zealously represent you.  Once a settlement is signed the case is over.  Talk to a lawyer first.  Moreover, military personnel often encounter unique issues.  Medical is provided at military facilities.  Injuries can affect your career.  In serious injuries especially, this can affect training opportunities, promotions and even normal retirement.  Make sure these factors are taken into account.  

 

Medical Malpractice – Military members are often treated in military facilities.  If they are the victim of military medical malpractice federal law prohibits filing a claim.  Family members however, may file claims for medical malpractice against military doctors for injuries they incur.  Do not be mislead, the “Feres doctrine” which prohibits military members from suing the military does not apply to family members.  Malpractice claims can be difficult, complicated, and expensive.  Federal law applies when the claim is against the military hospital.  Consult an attorney familiar with the Federal Torts Claims Act if you believe a family member has been injured as a result of medical malpractice in a military hospital.

 

Traffic Violations – These cases can range from simple infractions to Driving While Impaired.  In the military today, traffic violations and especially DWI can have a significant impact of your career.  Moreover, military personnel are often subject to deployment with little notice which can hamper court appearances.  Do not ignore traffic violations. Seek legal help. Traffic violations that are ignored can result in the loss of your privilege to drive in North Carolina.  Serious violations, if ignored, can result in arrest warrants.  Convictions can result not only in fines, but increased insurance rates and suspension of licenses.  Talk to a lawyer who is familiar with North Carolina law and the military community.
