Potential clients often ask me if they need a civilian lawyer.  Frankly, it is a bit self serving to say “yes.”  Ultimately, that is a question every soldier, sailor, airman or marine must ask themselves.  Clearly, there are things a civilian lawyer can do that a Judge Advocate cannot do.  First, Judge Advocates rarely represent suspects.  Often a Judge Advocate will be assigned only after charges have been preferred or discharge proceedings initiated.  A civilian attorney is free to begin representation before charges are preferred.  This can sometimes make a difference.

Moreover, important evidence can be obtained early in an investigation that can prevent charges from being filed.  Also, it is often a great benefit to have an attorney readily available for consultation when an investigation is ongoing.  Finally, there is the factor of experience.  As a young active duty Judge Advocate, I provided zealous and effective representation for my clients.  I have good results.  Still, I am a better lawyer now after 24 years of representing soldiers.  If you believe you may need a civilian lawyer make an appointment.  Then decide what is best for you.
