Potential clients often ask me if they need a civilian lawyer. Frankly, it is a bit self serving to say “yes.” Ultimately, that is a question every soldier, sailor, airman or marine must ask themselves. Clearly, there are things a civilian lawyer can do that a Judge Advocate cannot do. First, Judge Advocates rarely represent suspects. Often a Judge Advocate will be assigned only after charges have been preferred or discharge proceedings initiated. A civilian attorney is free to begin representation before charges are preferred. This can sometimes make a difference.
